Class B is still really high.

525.060 Disorderly conduct in the second degree.
(1) A person is guilty of disorderly conduct in the second degree when in a public place and with intent to cause public inconvenience, annoyance, or alarm, or wantonly creating a risk thereof, he:
(a) Engages in fighting or in violent, tumultuous, or threatening behavior;
(b) Makes unreasonable noise;
(c) Refuses to obey an official order to disperse issued to maintain public safety
in dangerous proximity to a fire, hazard, or other emergency; or
(d) Creates a hazardous or physically offensive condition by any act that serves no
legitimate purpose.

(2) Disorderly conduct in the second degree is a Class B misdemeanor.

History: Amended 2006 Ky. Acts ch. 50, sec. 2, effective March 27, 2006; and ch. 51,
sec. 2, effective March 27, 2006. -- Created 1974 Ky. Acts ch. 406, sec. 216,

They could still work out a deal, that it get dropped after community service and no more scrapes with the law.

Misdemeanor. Not a big deal if he does what they tell him (community service).Most likely removed from his record and stay out of trouble.

That is huge. The D needs all the returning players it can get. The O had a break out season last year. It is definately the Ds turn to shine, this season.

I have to wonder just how appropriate the original charges were, something appears to be amiss here.

It is the lowest class of crime in Kentucky other than a violation. The penalty for a Class B misdemeanor is up to 90 days in jail and/or a fine of up to $250. (For a violation the penalty is only a fine; those are offenses like jaywalking or speeding.)

I could not get access to the actual article, so I don't know to what you are responding here, R&B. Anyway, Dick Gabriel said pretty much the same last night. According to him, some policeman had used the wording "homemade BOMB." Gabriel said that perhaps had something to with our living in the post 9-11 period. He went on to say something about "homemade fireworks."

Gabriel also said that he didn't mean to be taking up for Marcus, as Marcus' actions were "stupid." He then talked about what a good guy Marcus is. I had shared here that he sang about his love for his mom at the women's clinic. You get the idea.

I just felt from the start that something was "amiss." I think you "know" me well enough to know that I would have wanted the guy suspended from the team if there had really been something like his "making a bomb." :lol:

Poo, sorry for the confusion. It would appear to me that the police officer that actually charged Marcus went a bit over the top.

I haven’t seen the original complaint and or arrest narrative however it would appear that felonious charges were not appropriate.

I certainly do not condone Marcus’s actions either.

Just remember the first axiom of Lexington Policedom: If it's a UK football player, name names immediately, and charge him with the most severe charge that you can. If he/she plays any other sport at UK, wrist-slap.

Seriously, it was a dumb thing to do, and he needs some community service to work the dumb out of him.
