LOUISVILLE, Ky. (AP) - A central Kentucky man whose penis was removed during an operation is suing the doctor and medical practice that performed the surgery, saying he was only in the hospital for a circumcision.
Phillip Seaton, 61, and his wife, Deborah Seaton, sued Dr. John M. Patterson and Commonwealth Urology in Frankfort, accusing Patterson of removing the organ despite specific instructions to only perform a circumcision as part of a treatment plan for a medical condition.

Seems odd that they would have to emphasize circumcision rather than amputation. I'd think the latter would have to be discussed, confirmed and discussed some more before it was done.

Depends on what is meant by "amputation", "circumcision", "inflammation" and what and where the cancer was and how extensive, etc. Also depends on what surgery was actually being performed and for what reason. Doubt very much this was a simple circ - why at the OR with anesthesia there?

I get multiple surgical consent forms signed by patients per day for urologic surgery. Any consent form will give EXPLICIT consent for medically necessary procedures.

So, depending on what we are talking about, it could easily have been malpractice NOT to go on and excise a lesion in a surgery for inflamed infected obstructed phimosis (which is what I assume we are talking about here). Is "amputation" equivalent to excision/partial penectomy in lawyer speak?

So obvious that this AP article is designed to be sensational and easy to sell as it so clearly portrays this as some sort of "mistake". Along the lines of cutting out the wrong structure... at worst, this was a judgement error-where the surgeon should have gotten permission even with a clear course of action before them.

Update: The doctor released a statement, said he isn't worried at all as he doesn't believe that the patient has the balls to sue! :icon_mrgreen:

I have talked to someone near the situation and this is blown way out of proportion. The man is still intact. This procedure happened over a year ago and just recently filed suit because someone else settled in a similar case in another state. The guy got a circumcision and another small portion trimmed off due to cancer. If I had a small bit of cancer on mine, I would want the doctor to take it off before it got any larger. It still functions the same way, but of course there is a little less than there was. I would be upset too, but I would also be thankful it was found early enough to prevent amputation.

The wife that made those statements was not even married to the guy when this happened. This is a bogus lawsuit that the lawyers hoped to settle quickly.

Luckily, the firm that represents the doctor has a history of not settling quickly or easily.

If they find out that this is overblown, they should charge the guy with a misdewiener for lying under on a court document. Sorry I had to do it.
